Liability
We are liable, regardless of the legal basis, without limitation for damages resulting from intentional or grossly negligent breaches of duty by us or by one of our legal representatives or vicarious agents.
In the event of a merely simple or slight negligent breach of duty by us or by one of our legal representatives or vicarious agents, we shall only be liable:
- without limitation for damages resulting from injury to life, body, or health;
- for damages resulting from the breach of essential contractual obligations. Essential contractual obligations are those obligations whose fulfillment is necessary for the proper execution of the contract and on whose compliance the customer regularly relies and may rely. In this case, our liability is limited in amount to the foreseeable damage typical of the contract at the time the contract was concluded.
The above limitations of liability do not apply insofar as we have fraudulently concealed a defect, assumed a guarantee as to the quality of the goods, or assumed a procurement risk. Mandatory statutory liability, in particular under the Product Liability Act, remains unaffected.
To the extent that our liability is excluded or limited under the above provisions, this also applies to the personal liability of our corporate bodies, legal representatives, employees, staff, and vicarious agents.
